Knowing Your rights in choosing an auto body company

 If you have been involved in an accident, one major consideration is going to be getting your car fixed, and getting it fixed right the first time. You have enough to deal with besides issues with your vehicle, and you don't have the time to bother with substandard auto body work.

Yet, as you will find, sometimes the insurance company wants to tell you that you cannot use the auto body company of your choosing.

It's important that you know your rights, so you can make sure that your needs—not the needs of the insurance company—are taken care of.

You have the right to choose the auto repair shop that you want to do your work.

The insurance company might suggest that you cannot take your vehicle to the repair shop that you choose, but must instead take it to one they choose. This is absolutely false! You have the right to take your car wherever you wish. Don't let the insurance company tell you otherwise.

You have the right to quality repairs.

If the auto repair shop you choose wants to use parts besides Original Equipment Manufacturer (OEM) parts, it must note this on your repair invoice. If the insurance company tells the auto shop to use non-OEM parts, the insurance company must then warrant that the parts are as good as, or better than, the OEM parts. This means that if the insurance company tries to pressure your auto repair shop to use non-OEM parts in the repair of your vehicle, the company must then stand behind those repairs. If the parts break and prove to be of lesser quality than OEM parts, the insurance company is on the hook for it.
